Anyone who lets residential property as a business activity is required by law to ensure the equipment they supply as part of the tenancy is safe.




Legislation


The Electrical Equipment (Safety) Regulations 1994, mandatory since 1 January 1997, states that all electrical appliances supplied with let accommodation must be safe. This applies to both new and second-hand appliances and covers all electrical items supplied for the intended use of the Tenant. The only sure method of ensuring that these appliances are safe is to have them tested by a trained competent person using the appropriate calibrated portable appliance testing equipment. Failure to comply with this piece of legislation could at worst result in the following;



  • A fine of £5,000 per item not complying
  • Six month's imprisonment
  • Possible manslaughter charges in the even of deaths
  • The Tenant may also sue you for civil damages
  • Your property insurance may be invalidated



What appliances need to be tested?


An electric appliance may be classed as "portable" if connected to the mains by way of a flexible lead and plug. All portable appliances in the property available for the tenant to use must be tested.




What do the tests entail?


The testing consists of two separate activities; a visual inspection to check for damage and poor electrical standards and a series of instrument tests to check for less obvious electrical faults.




How often should these tests be carried out?


Good practice suggests that annual tests afford maximum protection and compliance. If you instruct Morgan Randall to carry out your PAT test we’ll automatically contact you again in just under a year’s time to arrange a new one!




How much does a PAT test cost?
